I have got my I 485 rejectd when i filed during AUG 2007 due to Improper fees but we paid the correct fees.We refiled with saying "Improper Denials of I-485 " and double packed saying byboss mail room. We tryied more than 5 times always we got back saying PD is not current. Please advice me how to proceed on this.

I start to study WOM, my district court web doesn't list anything about that, then I find aonther site lists WOM cases filed in my district, but no status mentioned. Does anyone knows? I appreciate!

Completing Form ETA 750
AILA: Has the issue been resolved as to how to complete item 10 on Form ETA 750B? As discussed, the item asks for either 10a or 10b to be completed, whichever is appropriate, not both. Please note that Consulate location has not been a required entry since 1990. The reason the question existed was that under the pre-1990 preference system, one could process under a non-preference category with an approved labor certification and no I-140 petition so the question was necessary on the ETA 750. Since 1990, the item should have been marked "N/A". Therefore, we suggest that the item is no longer relevant.

You can file 485 only from within USA. So I believe you will be back to USA before filing 485.

They might have moved all non - preadjuicated files to NSC. TSC has nothing to process so may be close to current in processing time.

Hi friends,
I planning to change my employer after 180days and I want go for the fulltime by using my EAD because my I-485 will take next 3 or 4 years (PD May-2007). My present H1 is still Oct 2008 (labor and I-140 cleared).
1. What are the chances for rejecting my I-485 file?
Ans:Very less unless you violated any status or any law.
2. If my I-485 file rejected after my H1 expired (EAD using) ?
Ans:You are out of status, switch to in-status, like B1.
3. How to settle out this ? Do I need to go back india?
Ans:Yes, you need to go back and come on fresh H1.
Seniors please provide me suggestions.
Overall, enjoy the stay in EAD and don't worry much about what happens at I-485.

With Company A, my H-1B extension was filed on 8/22/2010, under regular processing.
My I-94 expiry date was 9/30/2010.
With Company B, H-1B transfer was filed on 10/2/2010 filed under Premium Processing
Received RFE on H-1B transfer. Responded on 10/22/2010.
Current status of H-1B transfer case is "RFE response review". No decision yet.
Meanwhile I got an RFE on H-1B extension on 10/25/2010.
1. How is the RFE on H-1B extension with Company A going to affect my H-1B transfer to Company B?
2. Should the H-1B extension be Approved before getting a decision on the H-1B transfer?

I have a question about the Aytes memo - it says that if the name check has been pending for more than 180 days, then the 485 will be adjudicated. My question is when does the 180 day clock start? Is it on the day that the 485 application was received by the service center (going by the receipt date on the 485 notice)? Or is it the day when your PD and processing dates both become current?

1) My GC was sponsored by company A. 240 days after my 485 was filed [I] moved to company B. Filed AC21 and using EAD. I am travelling on vacation using AP. At POE if I am asked who is sponsoring my GC, would my answer still be company A?/other
2) Do I need to carry AC21 docs? or will the employment letter from Company B suffice?
Please advise.

Just to be contrarian, I think the recent H1-B and L-1 fee increase is an opportunity. Instead of playing a victim of legislative abuse, we should come out batting with an offense. We should get businesses to lobby for us. We should get congress people educated about the unfairness. We should not say the fee is wrong, because these are after all elected officials and they will not jeopardize their election prospects by going against this measure. So we should say ok take this fee but then provide us with administrative fixes that we want.
The H1B/L1 fees is designed to hit the body shopping business model. It is nothing but a
legal/labor cost arbitrage that most indian IT service shops follow.
The fees is not the last but the beginning and more will be piled on as they will come back again in a year or so to fund more "secure the mexican border" initiatives. It is a beast that can never be satisfied. The American It companies are not impacted by the 50% rules and they care less about it. So it the resistance effort will be very minimal...like it happened this time.

Yours will be EB1C. You can expect to get GC in 1-2 years.
If i-140 premium processing comes back, then typically within an year. (know of 2 people who got done within 8 months... EB1-India). Right now the I-140 is going to take the longest time..

I've filed for the I-140 with EB-1 category in business, then additional evidence was requested and finally received a denial. I would like to know:
1. What are the chances to get approved after appealing?
2. If I were to appeal can I present new evidence?
3. After filing the appeal, how long should I expect to receive an answer from DC office?
4. If I ask for additional time before appealing, what are the chances that the additional time will be approved?
5. Is it better to appeal or to request a motion to reopen whenever I gather the new info to defend my case?
6. Do I have better chances if I skip both appealing and motion to reopen and focus on re filing a new case?
